This Privacy Policy explains how Benicia Medical Aesthetics ("we", "us" or "our") collects, uses and protects information about you when you visit beniciamedicalaesthetics.com (the "website"), send us a request through the website, or agree to receive text messages from us. By using the website, you agree to the practices described here.
Your medical information
This policy covers the website only. Medical information we create or receive while caring for you as a patient, such as your health history, treatment records and photos taken during your care, is protected under the Health Insurance Portability and Accountability Act (HIPAA) and California's Confidentiality of Medical Information Act. How we use and disclose that information is described in our Notice of Privacy Practices, which we provide at your first visit and which you can request at any time.
Please do not send detailed medical information through the website's contact form. We can discuss your health history at your consultation.
Information we collect
Information you give us. When you fill in the contact form, we collect your first and last name, email address, phone number, the treatment you are interested in, and anything you write in your message. When you book through our online scheduling page, the booking system collects the details you enter there, such as your name, contact details and your chosen appointment. When you use the chat window on the website, we collect what you type, including any name, phone number or email address you share.
Information collected automatically. When you send the contact form, we record the page you sent it from, the date and time, and your IP address, which helps us prevent spam and misuse. Like most websites, our hosting provider also keeps standard server logs, which can include your IP address, browser type, device type, the pages you request and the website that referred you.
Cookies and similar technologies. The website's own code does not set cookies. It stores one short-lived value in your browser's session storage to show a smooth transition between pages, and that value is removed when you close the tab. The visit tracking and analytics tools described below set cookies and may store values in your browser's local storage. Pages with an embedded Google map load content from Google, which may set its own cookies under Google's privacy policy, and our payment plans page loads a widget from Cherry, our financing provider, which may do the same under Cherry's privacy policy.
Visit and form tracking. Our customer relationship and scheduling system runs a script on every page of the website that records the pages you visit, the website that referred you, and the forms you send, and stores an identifier in a cookie and in your browser's local storage. If you later contact us or book, this lets us see how you found us and which pages you looked at. The provider handles this information on our behalf as our service provider.
Analytics. We use Google Tag Manager to load analytics tools, such as Google Analytics, that help us understand how visitors use the website in aggregate, for example which pages are visited most. Those tools may use cookies or similar technologies and collect information such as your IP address, device and browser details, and how you move through the website.
How we use your information
- To respond to your request, schedule and confirm appointments, and answer your questions.
- To call, text or email you about your request, your appointment, and our treatments, memberships and offers, if you have agreed to hear from us.
- To run, secure and improve the website, including preventing spam, fraud and misuse.
- To keep records of our communications with you.
- To comply with the law, and to protect our rights, our patients and the public.
Text messages
If you give us your mobile number and agree to be contacted, we may send you text messages about your request and appointments, such as confirmations and reminders, and, where you have agreed, occasional messages about our treatments and offers. Message frequency varies. Message and data rates may apply. Reply STOP to any message to stop receiving texts, or HELP for help. Agreeing to receive texts is not a condition of any purchase or treatment.
We do not share your mobile number or your text messaging opt-in with third parties or affiliates for their marketing or promotional purposes. Text messaging opt-in data and consent are never shared with any third party, except the service providers that deliver our messages for us.
How we share your information
We share personal information only as described here:
- Service providers that help us run our business and the website, such as our website host, our customer relationship and scheduling system, our text messaging and email providers, and our payment and financing providers. They may use your information only to provide services to us.
- Legal and safety reasons, when the law requires it, to respond to a valid legal request, or to protect the rights, property or safety of our patients, our practice or others.
- Business changes, if our practice is sold, merged or reorganized, in which case your information may transfer to the new owner under this policy.
- With your permission, in any other case.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
Third-party websites and services
The website links to, and embeds content from, other websites and services, such as Google Maps, our Google Business Profile, our online booking page and financing providers. Their own privacy policies apply to the information they collect. We are not responsible for their practices.
How long we keep information
We keep personal information for as long as we need it for the purposes above, including to provide services, keep business records and meet legal, tax and regulatory requirements. Patient medical records are kept for the periods required by California law.
How we protect information
We use reasonable administrative, technical and physical safeguards to protect personal information, and the website is served over an encrypted connection (HTTPS). No method of sending or storing information online is completely secure, so we cannot guarantee absolute security.
Your choices and rights
- Marketing. You can stop marketing texts by replying STOP, stop marketing emails with the unsubscribe link in any email, or ask us to stop calling you.
- Access, correction and deletion. You can ask us what personal information we hold about you from the website, ask us to correct it, or ask us to delete it. Some information we must keep by law, such as patient medical records.
- Browser settings. You can block or delete cookies in your browser. The website works without them.
We will not discriminate against you for making a privacy request. To protect your information, we may need to confirm your identity before acting on a request.
California privacy notices
California residents may ask, once a year and free of charge, whether we disclosed personal information to third parties for their own direct marketing purposes in the previous calendar year (California Civil Code section 1798.83). We do not make such disclosures.
Some browsers send a "Do Not Track" signal. There is no common standard for responding to it, so the website does not respond to Do Not Track signals. It does honor the Global Privacy Control signal as a request not to sell or share personal information, which we do not do in any case.
Children's privacy
The website is intended for adults. We do not knowingly collect personal information online from children under 16. If you believe a child has sent us personal information through the website, please contact us and we will delete it.
Changes to this policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top shows when it last changed. Changes take effect when posted on this page.
